Terms and Conditions

1. Scope of Service

ABACUS HVAC SOLUTIONS provides air conditioning sales, installation, repair, and maintenance services. By accessing our website, requesting a quote, or booking any service, the Customer agrees to comply with and be bound by these Terms and Conditions.

2. Quotes and Estimates

  • Validity: All quotations issued are valid for 30 days from the date of issue, unless otherwise stated.
  • Site Inspection: Final pricing is subject to a physical site inspection. If unforeseen or hidden conditions are identified—such as faulty electrical wiring, structural constraints, access limitations, or required ductwork modifications—a revised estimate will be issued for Customer approval before proceeding.

3. Manufacturer Warranties vs. Labor Warranties

  • Equipment Warranty: All air conditioning equipment is covered exclusively by the respective Manufacturer’s Warranty (e.g., Carrier, Toshiba, etc.). ABACUS HVAC SOLUTIONS is not liable for manufacturing defects but will provide reasonable assistance in coordinating warranty claims with the manufacturer.
  • Labor Warranty: A 12-month workmanship warranty is provided on installation services. This warranty excludes failures or damages caused by power fluctuations, improper usage, lack of routine maintenance (including filter cleaning), environmental factors, or third-party interference.
  • Warranty Registration: Certain manufacturers require product registration within 60–90 days of installation to activate full warranty coverage. While assistance may be provided, the Customer bears sole responsibility for timely registration.

4. Payments and Financing

  • Deposits: A 100% advance payment is required to confirm equipment orders and secure an installation schedule.
  • Final Payment: Any outstanding balance for services rendered is due immediately upon completion of installation or service.
  • Financing: Where third-party financing is used, all terms, conditions, approvals, and interest rates are governed solely by the financing provider. ABACUS HVAC SOLUTIONS assumes no responsibility for financing decisions or disputes.

5. Customer Responsibilities

  • Site Access: The Customer must ensure clear, safe, and unobstructed access to all work areas, including indoor units, outdoor units, rooftops, attics, crawlspaces, or electrical panels, as required for installation or service.
  • Approvals & Permits: Unless explicitly stated in the quotation, the Customer is responsible for obtaining any required Homeowners’ Association (HOA) or property management approvals. ABACUS HVAC SOLUTIONS will obtain standard municipal permits when legally required.

6. Cancellations and Rescheduling

  • Service Appointments: A minimum of 24 hours’ notice is required for cancellations or rescheduling. Failure to provide timely notice, including no-shows, may result in a late cancellation or no-show fee of $[Amount].
  • Equipment Orders & Returns: Special-order, custom, or built-to-order equipment and parts are non-returnable once shipped. If an order is cancelled after shipment, a 20% restocking fee (or manufacturer-imposed charges) may apply, subject to supplier policies.

7. Limitation of Liability

ABACUS HVAC SOLUTIONS shall not be held liable for any indirect, incidental, or consequential damages, including but not limited to loss of business, loss of profits, spoiled goods, or inconvenience arising from equipment malfunction, service delays, or manufacturer-related part supply issues.
